Terms of Use

Effective date: August 21, 2026

These Terms of Use (“Terms”) govern your access to and use of thecolorizer.com, including its palette generator, AI-powered palette-description feature, exports, content, and related functionality (collectively, the “Site”). The Site is provided by The Colorizer (“The Colorizer,” “we,” “us,” or “our”).

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Site. By using the Site, you represent that you meet these requirements.

The Site is offered for lawful creative, educational, professional, and business use. It is not directed to children.

2. Beta service

The Colorizer is currently offered as a beta product. Features may be incomplete, experimental, changed, suspended, or removed without notice. Palettes, AI results, exports, and other functionality may contain errors or behave unexpectedly.

Do not rely on the Site as the only copy of important work. Download and retain your own copies of any palette or export you wish to keep.

3. What the Site does

The Site allows you to create, edit, randomize, lock, and export color palettes. ASE, PNG, and CSS exports are generated in your browser and downloaded to your device.

The optional AI feature allows you to enter a short text description of a palette. The Site sends the prompt, requested color count, and locked HEX colors through the Lovable AI Gateway to a Google Gemini model, which returns proposed HEX values and a short palette name.

The Colorizer may change the AI model, providers, limits, interface, export types, or other technical implementation at any time.

4. Your prompts and inputs

You retain any rights you have in text or other material you submit to the Site (“Input”). You grant The Colorizer and its service providers a limited, nonexclusive right to transmit, process, and return your Input solely as needed to operate the requested feature, maintain security, and comply with law.

You are responsible for your Input and represent that:

  • you have the right to provide it;
  • it does not violate law or another person’s rights;
  • it does not contain malicious code or instructions intended to interfere with the Site; and
  • it does not include personal, sensitive, confidential, regulated, or proprietary information.

AI prompts are limited to 200 characters. Do not use an AI prompt as a place to store information.

5. Palette output and exports

Subject to these Terms and applicable law, you may use, modify, download, and share palettes and export files generated for you by the Site for personal or commercial projects.

You acknowledge that:

  • individual colors, HEX values, and common color relationships may not be protected by intellectual-property law;
  • generated palette names or arrangements may be similar or identical to material generated for other users;
  • AI output is not exclusive to you;
  • The Colorizer does not represent that any output is original, protectable, noninfringing, or suitable for trademark or brand registration; and
  • you are responsible for reviewing output and determining whether your intended use is lawful and appropriate.

The Colorizer does not claim ownership of your Input or of a palette export generated for you, except for our preexisting Site code, interface, branding, documentation, and other protected materials incorporated into or used to create the export.

6. No guarantee of accessibility, compliance, or design fitness

Generated palettes are creative starting points. They are not professional design, legal, accessibility, medical, safety, or compliance advice.

A palette is not automatically accessible because it was generated by the Site. Accessibility depends on the specific pairing, text size, font weight, interface state, background, context, and applicable standard. You are responsible for testing actual foreground and background combinations and for meeting any WCAG, ADA, Section 508, brand, contractual, or other requirements that apply to your project.

The Colorizer does not guarantee color accuracy across screens, browsers, printers, materials, lighting conditions, color profiles, or production processes. ASE, PNG, and CSS exports may render differently in different software and environments.

7. AI-specific terms

The AI feature uses third-party generative AI. AI output may be inaccurate, incomplete, unexpected, biased, offensive, unsuitable, or technically invalid. It may not reflect your intent, and it may produce the same or similar output for others.

You must independently review AI-generated colors and names before using or publishing them. You may not represent that an AI-generated palette is guaranteed to be harmonious, accessible, legally protectable, scientifically authoritative, or appropriate for every context.

Use of the AI feature is also subject to applicable provider terms, including Lovable’s terms and the Gemini API Additional Terms. Provider safety systems may reject or modify a request.

8. Acceptable use

You may not use the Site to:

  • violate any law, regulation, court order, or third-party right;
  • submit content you do not have the right to use;
  • submit personal, sensitive, confidential, regulated, or proprietary information to the AI feature;
  • generate, distribute, or facilitate unlawful, deceptive, abusive, threatening, hateful, exploitative, or harmful material;
  • impersonate another person or misrepresent your affiliation;
  • probe, scan, test, bypass, disable, or interfere with security or access controls;
  • reverse engineer, extract, scrape, copy, or systematically collect the Site, model, prompts, outputs, or underlying data except as permitted by law;
  • use bots or automated systems in a manner that imposes an unreasonable load or circumvents usage limits;
  • introduce malware, harmful code, or disruptive instructions;
  • attempt to obtain another user’s data or access nonpublic systems;
  • use the Site to develop or benchmark a competing model or service in violation of applicable provider terms; or
  • remove or obscure legal, copyright, trademark, or attribution notices.

We may restrict or block activity that we reasonably believe violates these Terms, threatens the Site or others, creates legal risk, or generates excessive cost or load.

9. The Colorizer’s intellectual property

The Site—including its software, interface, visual design, text, logos, trademarks, branding, documentation, and compilation—is owned by or licensed to The Colorizer and is protected by applicable intellectual-property laws.

These Terms give you a limited, revocable, nonexclusive, nontransferable right to use the Site for its intended purpose. They do not transfer ownership of the Site or authorize you to copy, sell, sublicense, distribute, frame, or create a competing service from it.

“The Colorizer,” its logo, and related branding may not be used without prior written permission.

10. Third-party services and links

The Site relies on third-party services, including Lovable hosting, Lovable edge infrastructure, the Lovable AI Gateway, Google Gemini, and Google Fonts. Those services are governed by their own terms and privacy policies.

The Colorizer does not control and is not responsible for third-party services, data practices, content, security, availability, or changes. A link to a third-party policy or site does not constitute an endorsement.

Your use of third-party software to open ASE, PNG, or CSS exports is governed by the terms of that software provider.

11. Privacy

Our Privacy Policy explains how information is processed when you use the Site. By using the Site, you acknowledge that information will be processed as described there.

12. Feedback

If you send suggestions, ideas, bug reports, or other feedback about the Site, you grant us a perpetual, worldwide, nonexclusive, royalty-free right to use, reproduce, modify, publish, and incorporate that feedback without restriction or compensation. This does not give us ownership of your palette Input or exports.

13. Availability, modification, and termination

We may modify, limit, suspend, discontinue, or replace any part of the Site at any time. We do not guarantee that the Site, a particular model, an export type, or a generated palette will remain available.

We may suspend or terminate your access if we reasonably believe you violated these Terms, created security or legal risk, abused third-party services, or interfered with operation of the Site.

Sections that by their nature should survive termination—including intellectual property, disclaimers, limitations of liability, indemnity, and dispute provisions—will survive.

14. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THE COLORIZER DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND QUIET ENJOYMENT.

WE DO NOT WARRANT THAT THE SITE OR ANY PALETTE, NAME, AI RESPONSE, OR EXPORT WILL BE ACCURATE, UNIQUE, ERROR-FREE, ACCESSIBLE, COMPLIANT, AVAILABLE, SECURE, OR SUITABLE FOR YOUR PURPOSE. WE DO NOT WARRANT THAT DEFECTS WILL BE CORRECTED OR THAT THE SITE WILL BE FREE OF HARMFUL COMPONENTS.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COLORIZER AND ITS OWNER, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, FILES, OR USE, ARISING FROM OR RELATED TO THE SITE, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF THE COLORIZER AND ITS OWNER, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO THE COLORIZER TO USE THE SITE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US$100.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.

16. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless The Colorizer and its owner, affiliates, licensors, and service providers from claims, liabilities, damages, judgments, losses, and reasonable costs arising from your Input, your use or misuse of the Site or output, your violation of these Terms, or your violation of law or another person’s rights.

This section does not require a consumer to indemnify a party for conduct for which indemnification cannot lawfully be required.

17. Governing law and disputes

These Terms are governed by the laws applicable in the jurisdiction where The Colorizer’s operator is established, without regard to conflict-of-law rules, except to the extent consumer-protection law in your place of residence requires otherwise.

Before filing a claim, you agree to contact us at hello@learningbydesign.co and make a good-faith effort to resolve the dispute informally for at least 30 days. If a dispute cannot be resolved, it may be brought in a court with lawful jurisdiction over the dispute and the parties.

Nothing in this section limits rights or remedies that cannot be waived under applicable consumer law.

18. Changes to these Terms

We may update these Terms as the Site, providers, business model, or law changes. Updated Terms will be posted with a revised effective date. Material changes may also be communicated through a prominent Site notice when appropriate.

Your continued use of the Site after updated Terms take effect constitutes acceptance of the revised Terms. If you do not agree to a revision, stop using the Site.

19. General terms

These Terms and the Privacy Policy are the entire agreement between you and The Colorizer regarding the Site, unless another written agreement expressly applies.

If any provision is found unenforceable, it will be modified only as much as necessary, and the remaining provisions will remain in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a reorganization, financing, merger, acquisition, or transfer of the Site.
